Human Rights and Public Freedoms

Rights and freedoms are the result of the convergence of various elements and values—historical, religious, and environmental—across different eras. For this reason, it is difficult to clearly define and regulate these rights and freedoms. Nevertheless, the demand for rights has become a fundamental and universal aspiration for all of humanity across societies, especially in light of the evolving nature and structure of modern states.

There is no doubt today that the issue of rights and freedoms has become of paramount importance, both internationally—particularly with the increase in crimes and violations committed by certain quasi-states against vulnerable minorities—and domestically, as a social and legal necessity imposed by the constraints and guarantees of the rule of law.

Accordingly, the content of this training program aims to address recent developments in Algerian administrative law, with a special focus on the evolution of rights and freedoms in Algerian constitutions, as well as in international and regional charters. This is achieved through a selection of modules designed to serve the core themes of the training and align with the nature of the specialization.

The proposed research topics in this presentation will revolve around the subject of fundamental rights and freedoms of individuals. The focus will be placed on the most significant mechanisms established by national legislation—particularly Algerian law—for the protection, safeguarding, and promotion of these fundamental rights and freedoms.

Among the central themes, special attention will also be given to the main constitutional and administrative institutions created by the Constitution and legal framework, which are entrusted with ensuring the protection and enhancement of rights and freedoms, as well as their development and promotion.

This overall vision and research direction will be materialized through a set of proposed research topics, including:

The key legislative guarantees for the protection of rights and freedoms,

The role of the Constitutional Court in safeguarding these rights and freedoms,

An analysis of how the national legislator has worked to promote political rights, especially those of women.

To be eligible for admission into the third-cycle Doctoral training program.
